Record relief, explained

Vacating a conviction: identify the legal route

Vacating a conviction can refer to different procedures. Determine whether the issue concerns a record-relief statute, an invalid conviction or another specific legal ground.

General information from public sources. This guide does not decide eligibility or provide representation.

Explain why you are seeking vacatur

A completed sentence, a claimed error in the conviction and a special statutory ground raise different questions. Preserve the underlying documents and avoid selecting a packet by its title alone.

Check state guidance

Washington provides conviction-vacation procedures, but that terminology does not establish the law elsewhere. Use the actual case jurisdiction and current statute.

Get advice on connected consequences

If an immigration case, appeal or other proceeding is involved, obtain specialist advice. The basis for an order and its effect under another body of law need careful review.

Common question

Does vacatur always seal the court file?
